1. Introduction and Acceptance

1.1 About nanopixo

nanopixo is an online platform for creating, editing and publishing visual content, including videos, images, infographics and other media forms. nanopixo offers a combination of templates, design tools, artificial intelligence (AI) features, media integrations and collaboration capabilities.

1.2 Scope of Application

These Terms of Service apply to all users of nanopixo, regardless of whether they have a free account, a paid individual subscription, or a team/enterprise subscription. By using our services, you agree to these terms.

1.3 Agreement

By creating an account or using nanopixo's services, you enter into a binding agreement with nanopixo. If you do not agree to these terms, you may not use the platform.

2. Definitions

  • nanopixo: is a product and brand name operated by GET IT Forward BV, a company incorporated under Belgian law, with its registered office at Viermaartlaan 1A, 9600 Ronse, registered under company number BE1033314868. The term “we”, “us” and “our” in these terms and conditions always refers to GET IT Forward BV, trading under the name nanopixo.
  • User: Any natural or legal person who registers and/or uses nanopixo.
  • Services: All functionalities, tools, templates and services offered by nanopixo.
  • Content: All materials uploaded, created or published by the User via nanopixo.
  • Subscription: An agreement whereby the User gains access to certain premium features for a fee.
  • GDPR: The General Data Protection Regulation.

3. Registration and Account

3.1 Account Creation

  • To use nanopixo, you must create an account by providing an email address and password.
  • You are required to provide accurate, current and complete information.
  • You may only create one account per person, unless you have a team or enterprise subscription.

3.2 Age Requirement

  • You must be at least 16 years old to create an account.
  • For users under 18, consent from a parent or guardian is required.
  • nanopixo reserves the right to perform age verification in case of doubt.

3.3 Account Security

  • You are responsible for keeping your login credentials confidential.
  • You are liable for all activities that occur through your account.
  • In case of suspected unauthorized use, you must immediately notify nanopixo.

3.4 Business Accounts

  • Companies can create a business account for multiple users.
  • The account holder (admin) is responsible for all users within the organization.
  • Additional terms may apply to team and enterprise packages.

4. Services and Functionality

4.1 Overview of Services

nanopixo offers, among others:

  • Video and image editing tools
  • AI-based features (automatic subtitling, background removal, etc.)
  • Access to a library of templates, stock photos, videos and music
  • Export options in various formats and resolutions
  • Collaboration tools for teams
  • Integrations with external platforms (social media, cloud storage)

4.2 Free and Paid Plans

  • Free plan: Offers basic functionality with limitations (such as watermarks, limited exports).
  • Paid plans: Offer advanced features, higher export limits and no watermarks.
  • nanopixo reserves the right to change the functionality of plans with a notice period of at least 30 days.

4.3 Availability

  • nanopixo aims for an uptime of at least 99.5% (see SLA for details).
  • Scheduled maintenance is announced at least 48 hours in advance.
  • nanopixo is not liable for downtime due to force majeure, DDoS attacks, or failures at third parties.

4.4 Changes and Updates

  • nanopixo may adjust, improve or add new features to the services at any time.
  • Substantial changes that negatively affect the user experience are announced at least 30 days in advance.

5. Use of Services

5.1 Permitted Use

You may use nanopixo for:

  • Creating your own visual content for personal or commercial purposes.
  • Editing and exporting content within the limits of your chosen subscription.
  • Sharing content with others, provided you have the appropriate rights.

5.2 Prohibited Use

You may not use nanopixo for:

  • Illegal activities or content that violates the law.
  • Uploading content that infringes on the intellectual property rights of third parties.
  • Distributing malware, viruses or other harmful code.
  • Violating the privacy or other rights of third parties.
  • Spamming, phishing or other forms of abuse.
  • Bypassing security measures or technical limitations.
  • Scraping, crawling or automatically collecting data from the platform.

5.3 Consequences of Abuse

  • In case of violation of these terms, nanopixo may temporarily or permanently suspend your account.
  • nanopixo reserves the right to remove content without prior warning.
  • In serious cases, nanopixo may take legal action.

6. Payment and Billing

6.1 Prices and Subscriptions

  • Prices for paid subscriptions are listed on the nanopixo website.
  • All prices are exclusive of VAT, unless otherwise stated.
  • nanopixo reserves the right to change prices with a notice period of at least 30 days.

6.2 Payment Methods

  • nanopixo accepts various payment methods, including credit card, iDEAL, PayPal and bank transfer.
  • Payment is made via secure external payment providers.
  • You are responsible for keeping your payment information up to date.

6.3 Billing and Renewal

  • Subscriptions are automatically renewed at the end of the billing period, unless you cancel.
  • Invoices are sent digitally to the email address you provided.
  • In case of failed payments, you will receive a reminder email. After 14 days, your account may be suspended.

6.4 Cancellation

  • You can cancel your subscription at any time through your account settings.
  • The cancellation takes effect at the end of the current billing period.
  • No refund will be given for the current period, unless otherwise stated in the Refund Policy.

7. Intellectual Property

7.1 Ownership of nanopixo

  • All rights to the platform, software, templates, trademarks and logos are owned by nanopixo.
  • You receive a limited, non-exclusive, non-transferable license to use the platform.

7.2 User Ownership

  • You retain all rights to the content you upload or create via nanopixo.
  • By uploading content, you grant nanopixo a worldwide, royalty-free license to host, process and display it.

7.3 AI-Generated Content

  • For AI-generated content (such as automatic subtitling), you retain the rights, provided you own the source material.
  • nanopixo claims no ownership of AI-generated output.

8. Privacy and Data Protection

The collection, use and protection of your personal data is described in detail in our Privacy Policy. By using nanopixo, you consent to the processing of your data as described in that statement.

9. Liability and Warranties

9.1 Disclaimer

  • nanopixo provides the services "as is" without any warranties.
  • nanopixo does not guarantee that the services are error-free, uninterrupted or secure.

9.2 Limitation of Liability

  • nanopixo is not liable for indirect damages, consequential damages, loss of profit or data loss.
  • The total liability of nanopixo is limited to the amount you have paid in the last 12 months.

9.3 User Responsibility

  • You are responsible for making backups of your content.
  • You indemnify nanopixo from all third-party claims arising from your use of the services.

10. Termination

10.1 By User

  • You can delete your account at any time through your account settings.
  • After deletion, your data will be deleted according to our retention policy (see Privacy Policy).

10.2 By nanopixo

  • nanopixo may suspend or delete your account in case of violation of these terms.
  • nanopixo may discontinue the services with a notice period of at least 90 days.

11. Changes to the Terms

  • nanopixo reserves the right to modify these terms.
  • Changes will be announced at least 30 days in advance via email or a notification on the platform.
  • By continuing to use the platform after the effective date of the changes, you accept the new terms.

12. Applicable Law and Disputes

12.1 Applicable Law

These terms are governed by the laws of Belgium.

12.2 Dispute Resolution

  • Parties will first attempt to resolve disputes through mutual consultation.
  • If no solution is reached, the courts of Belgium have jurisdiction.

13. Final Provisions

13.1 Entire Agreement

These terms, together with the additional documents, constitute the entire agreement between you and nanopixo.

13.2 Severability

If any provision is void or invalid, the remaining provisions remain in force.

13.3 No Waiver of Rights

The failure to exercise a right by nanopixo does not constitute a waiver of that right.

You can request a copy of your data in a structured, common format (such as JSON or CSV). You can download this through your account settings.

8.6 Right to Object

You can object to processing based on legitimate interest, such as marketing purposes.

8.7 Right to Withdraw Consent

If processing is based on consent, you can withdraw it at any time (for example by unsubscribing from newsletters).

8.8 Right to Complain

You have the right to file a complaint with the Data Protection Authority (DPA) if you believe we are not handling your data properly.

1. Introduction

1.1 Scope

This Data Processing Agreement (hereinafter "DPA") applies to all business customers of nanopixo who process personal data of third parties (such as customers, employees, or end users) via the nanopixo platform.

1.2 Relationship to Other Documents

This DPA supplements the General Terms and Conditions and the Privacy Policy. In case of conflict, the provisions of this DPA prevail.

1.3 GDPR Compliance

This DPA has been drafted in accordance with the requirements of Article 28 of the General Data Protection Regulation (GDPR).

2. Definitions

  • Controller: The Customer, who determines why and how personal data is processed.
  • Processor: nanopixo, which processes personal data on behalf of the Controller.
  • Sub-processor: A third party engaged by nanopixo to carry out certain processing activities.
  • Personal Data: All information that can be traced back to an identified or identifiable natural person.
  • Processing: Any operation concerning personal data, such as collecting, storing, using, providing, or deleting.
  • Data Subject: The natural person whose personal data is being processed.
  • Data Breach: A security breach that leads to loss, alteration, or unauthorized access to personal data.
  • Supervisory Authority: The Data Protection Authority or another competent privacy supervisory body.

3. Roles and Responsibilities

3.1 The Customer as Controller

The Customer is responsible for:

  • Determining the purposes and means of processing
  • Obtaining a lawful basis for processing
  • Informing data subjects about the processing
  • Conducting a privacy impact assessment (if required)
  • Handling data subject requests (access, rectification, erasure, etc.)
  • Reporting data breaches to the supervisory authority (if required)

3.2 nanopixo as Processor

nanopixo is responsible for:

  • Processing personal data solely according to the Customer's instructions
  • Implementing appropriate technical and organizational security measures
  • Ensuring confidentiality of personnel
  • Assisting with handling data subject requests
  • Reporting data breaches to the Customer
  • Deleting or returning data after termination

4. Nature and Purpose of Processing

4.1 Processing Activities

nanopixo processes personal data on behalf of the Customer for the following purposes:

  • Hosting and storing content uploaded by the Customer
  • Processing videos, images, and other media
  • Performing AI functions (such as automatic subtitling, facial recognition if enabled)
  • Providing collaboration tools for teams
  • Providing analytical insights about platform usage
  • Providing technical support

4.2 Types of Personal Data

Depending on the Customer's use, the following personal data may be processed:

  • Name and contact details of end users
  • Visual material (photos, videos) in which persons are visible
  • Voice recordings and audio fragments
  • Location data (if present in metadata)
  • IP addresses and technical identifiers
  • Other data uploaded by the Customer

4.3 Categories of Data Subjects

  • The Customer's customers
  • The Customer's employees
  • The Customer's website visitors
  • Other persons appearing in content uploaded by the Customer

4.4 Special Categories of Data

nanopixo advises against uploading special categories of personal data (such as health information, religious beliefs, biometric data), unless the Customer has an explicit and lawful basis for doing so.

5. Processing Instructions

5.1 General Instructions

  • nanopixo processes personal data solely based on documented instructions from the Customer.
  • These instructions are given through the use of the platform and available features.
  • If nanopixo believes an instruction conflicts with the GDPR, nanopixo will immediately inform the Customer.

5.2 Specific Instructions

The Customer can provide additional instructions via:

  • Account settings and configurations
  • API requests (if applicable)
  • Written requests to support@nanopixo.com

5.3 Legal Obligation to Process

If nanopixo is legally required to process personal data (for example, by court order), nanopixo will inform the Customer, unless legally prohibited from doing so.

6. Security Measures

6.1 Technical Security Measures

  • Encryption:
    • TLS 1.3 for data in transit
    • AES-256 for data at rest
    • End-to-end encryption for sensitive content (optional)
  • Access Control:
    • Role-based access control (RBAC)
    • Multi-factor authentication (MFA) for admins

    • DDoS protection via Cloudflare
    • Network segmentation
  • Monitoring and Logging:

7. Sub-processors

7.1 General Authorization

The Customer hereby gives general authorization to nanopixo to engage sub-processors, provided that nanopixo:

  • Ensures a written agreement with the same obligations as in this DPA
  • Informs the Customer of changes to the list of sub-processors
  • Gives the Customer the opportunity to object

7.2 Current Sub-processors

nanopixo uses the following sub-processors:

  • Amazon Web Services (AWS): Hosting and storage (EU regions)
  • Google Cloud Platform: AI services and analytics (EU regions)
  • Stripe: Payment processing (EU/US, with EU standard contractual clauses)
  • SendGrid: Email services (EU/US, with EU standard contractual clauses)
  • Cloudflare: CDN and DDoS protection (worldwide, with EU standard contractual clauses)

7.3 Change of Sub-processors

  • nanopixo informs the Customer at least 30 days in advance about the addition or replacement of sub-processors.
  • The Customer can object within 14 days if there is a justified reason.
  • In case of objection, nanopixo will try to find an alternative or give the Customer the opportunity to terminate the agreement.

7.4 Liability

nanopixo remains fully liable to the Customer for the performance of sub-processors.

8. Data Subject Rights

8.1 Support

nanopixo will assist the Customer in handling data subject requests, including:

  • Right of access
  • Right to rectification
  • Right to erasure ("right to be forgotten")
  • Right to restriction of processing
  • Right to data portability
  • Right to object

8.2 Procedure

  • Data subject requests must be handled by the Customer.
  • If nanopixo receives a request, it will be forwarded to the Customer.
  • nanopixo provides technical support (such as data export) within 5 business days.

8.3 Costs

Standard support is free. For extraordinary requests that are time-consuming, nanopixo reserves the right to charge reasonable costs.

9. Data Breaches

9.1 Notification Obligation

nanopixo notifies the Customer of a data breach:

  • As soon as possible, and in any case within 48 hours of discovery
  • Via email to the contact address provided by the Customer
  • Including:
    • The nature of the data breach
    • The categories and number of data subjects
    • The likely consequences
    • The measures taken and proposed

9.2 Customer Responsibility

The Customer is responsible for:

  • Assessing whether the data breach must be reported to the supervisory authority (within 72 hours)
  • Informing data subjects (if required)
  • Documenting the data breach

9.3 Investigation and Remediation

nanopixo will:

  • Immediately start investigating the cause
  • Take measures to prevent further damage
  • Inform the Customer about progress
  • Prepare a post-incident report

10. Audit and Inspection

10.1 Right to Audit

The Customer has the right to verify that nanopixo complies with this DPA. This can be done in the following ways:

  • By requesting access to certifications (ISO 27001, SOC 2)
  • By conducting an audit (maximum once per year)

10.2 Audit Procedure

  • The Customer must submit a written request at least 30 days in advance
  • Audits take place at an agreed time during business hours
  • The auditor must sign a non-disclosure agreement
  • Costs of the audit are borne by the Customer

10.3 Documentation

nanopixo provides upon request:

  • Copies of relevant certifications
  • Documentation of security measures
  • Overview of sub-processors

11. International Data Transfers

11.1 Location of Data Processing

  • Primary processing takes place within the EU/EEA
  • Some sub-processors have servers outside the EU (for example, in the US)

11.2 Safeguards

For transfers outside the EU, nanopixo ensures:

  • EU standard contractual clauses (SCCs)
  • Adequacy decision (if applicable)
  • Additional security measures (such as encryption)

11.3 Transparency

nanopixo informs the Customer about the location of data processing and changes thereto.

12. Deletion and Return of Data

12.1 After Termination

After termination of the agreement, nanopixo will, at the Customer's choice:

  • Delete all personal data, or
  • Return a copy in a common format (JSON, CSV)

12.2 Period

  • Deletion or return takes place within 30 days after termination
  • The Customer can extend this period (maximum 90 days)

12.3 Exceptions

Data that must be retained by law (such as invoices) remain stored according to the legal retention period.

12.4 Backups

Data in backups are deleted according to the normal retention policy (maximum 90 days).

13. Liability

13.1 Obligations

Both parties are liable for compliance with their obligations under this DPA and the GDPR.

13.2 Damages

  • In case of breach by nanopixo, nanopixo is liable for direct damages
  • Liability is limited as stated in the General Terms and Conditions
  • nanopixo is not liable for breach of instructions by the Customer

14. Term and Termination

14.1 Term

This DPA enters into force at the time of acceptance of the General Terms and Conditions and remains in force as long as nanopixo processes personal data on behalf of the Customer.

14.2 Termination

This DPA terminates automatically upon termination of the agreement between the Customer and nanopixo.

15. Amendments

  • nanopixo may amend this DPA to comply with new legislation or best practices
  • Material changes will be announced at least 30 days in advance
  • The Customer may object and terminate the agreement

This document forms an integral part of the General Terms and Conditions. In case of conflicts, the General Terms and Conditions prevail.

This SLA clarifies:

  • What level of availability users can reasonably expect
  • How technical support is provided
  • What limitations and exceptions apply
  • What is NOT part of the service

Important: GET IT Forward BV delivers nanopixo on a best-effort basis, without performance obligations.

2. Service Availability

2.1 "As Is" Delivery

nanopixo is delivered on an "as is" and "as available" basis. We strive for stable service delivery, but give no guarantee regarding:

  • Availability
  • Uninterrupted operation
  • Uptime percentages
  • Processing times
  • Error-free operation
  • Availability of AI models or external systems

2.2 Possible Limitations

The Service may be temporarily limited by, among others:

  • Maintenance
  • Software updates
  • Network problems
  • Capacity limitations
  • Outages at external providers
  • Factors beyond our control (force majeure)

2.3 No Guaranteed Uptime

Uptime percentages are not guaranteed. GET IT Forward BV does not provide service credits or compensation for interruptions.

3. Maintenance & Updates

3.1 Flexibility

We may update or maintain the Service at any time. Maintenance may lead to temporary unavailability.

3.2 Maintenance Windows

Maintenance is performed:

  • Without prior notice
  • At times determined by GET IT Forward BV
  • When necessary for security or performance

3.3 Necessity

The Customer acknowledges that maintenance is essential for the proper functioning of AI services.

4. Performance & Processing Time

4.1 Variable Processing Times

AI output processing times may vary due to:

  • Server load
  • Queues
  • External AI models
  • Network latency
  • Size of User Content

4.2 No Commitments

GET IT Forward BV makes no commitments regarding speed, consistency, or availability of specific models or functionalities.

5. Support

Response times are best-effort. GET IT Forward BV does not guarantee a response time, but aims to respond within a reasonable period.

5.4 What Support Does NOT Cover

Support explicitly does not cover:

  • Training, consultation, or advice
  • Legal or technical interpretation of AI output
  • Problems caused by external systems
  • Custom development, integrations, or API development
  • Use of AI results outside the Service

6. Changes to the Service

6.1 Flexibility

GET IT Forward BV may at any time:

  • Modify functionalities
  • Add or remove AI models
  • Optimize or limit operation
  • Replace components
  • Adjust interfaces

6.2 No Continuity Guarantee

There is no obligation to maintain continuity of specific functions, models, or outputs.

6.3 No Compensation

The Customer has no right to compensation for changes to the Service.

7. External Systems & Sub-processors

7.1 Dependencies

nanopixo uses technology from external parties such as:

  • Cloud providers
  • AI model providers
  • Hosting infrastructure
  • Monitoring and security services

7.2 Third-Party Service Levels

These external parties have their own service levels and availability parameters. GET IT Forward BV has no control over their uptime.

7.3 No Liability

GET IT Forward BV is not liable for interruptions caused by external systems.

8. Limitations & Exclusions

The following situations are not covered by this SLA:

  • Interruptions due to maintenance
  • Outages caused by third parties
  • Internet problems between user and servers
  • Incorrect use of the Service
  • Overload due to intensive use
  • Misconfigurations by the user
  • Delays in AI processing
  • Errors in AI output
  • Force majeure (nature, legislation, war, strikes…)

9. Liability

This SLA follows the liability limitations in the General Terms and Conditions.

Specifically:
All liability of GET IT Forward BV is excluded to the extent permitted by law. If liability cannot be fully excluded, it is limited to the monetary value of the credits consumed for the specific processing from which the alleged damage arose, with an absolute maximum of €100.

GET IT Forward BV does not grant service credits or refunds based on this SLA.

10. Changes to this SLA

GET IT Forward BV may modify this SLA at any time. The most recent version is always available on the website. In case of substantial changes, the Customer may be informed via the Service or by email.

11. Applicable Law

This SLA is governed by Belgian law. Disputes fall under the exclusive jurisdiction of the courts of Oudenaarde, Belgium.

2. Permitted Use

You are fully responsible for all content you input, generate, or distribute.

3. Prohibited Activities

GET IT Forward BV has full discretion to determine whether behavior falls within the categories below.

  • Fraud, deception, phishing, scamming
  • Money laundering practices
  • Violations of privacy legislation
  • Circumventing legal restrictions

3.2 Intellectual Property

Prohibited:

  • Uploading or processing material for which you do not own rights
  • Generating output that may infringe on third-party rights
  • Using AI models to copy or imitate existing works

3.3 Harmful or Misleading Content

Prohibited:

  • Deliberately misleading or manipulative information
  • Defamation, threats, intimidation, or hateful content
  • Extremist, terrorist, or violent content
  • Promotion of self-harm

3.4 Deepfakes and Imitations

Prohibited:

  • Generating deepfakes without explicit written consent
  • Imitation of voices, persons, signatures, or identities
  • Synthetic reproduction of persons in contexts that may be harmful or misleading

3.5 Professional Advice

The Service may not be used for:

  • Legal, medical, tax, or financial advice
  • Any advice requiring a regulated professional qualification

AI output may contain errors and is not intended as professional advice.

3.6 Security Breaches

Prohibited:

  • Hacking, testing, manipulating, or circumventing security mechanisms
  • Reverse engineering or attempting to access non-public systems
  • Distributing malware, viruses, or malicious code

3.7 System Abuse

Prohibited:

  • Bulk scraping
  • Massive request loads or activities that overload systems
  • Automation intended to manipulate limits or credit consumption
  • Competitive model training

3.8 Child Safety

Strictly prohibited:

  • Any form of sexual or suggestive content involving minors
  • Manipulation of visual material involving minors
  • Images, videos, or AI output that compromises minors

Violation leads to immediate and permanent account termination.

3.9 Pornography and Sexually Explicit Content

It is strictly prohibited to use the Service for generating, uploading, processing, or distributing:

  • Pornographic content
  • Sexually explicit material
  • Erotic or sexual acts
  • Visual or textual material with sexual intent
  • Suggestive representations intended as erotic or pornographic
  • Any material that sexualizes persons

This prohibition applies regardless of:

  • Whether the persons involved are 18+
  • Whether the content is legal in the user's jurisdiction
  • Whether consent was given

Violation results in immediate, permanent account termination.

4. User Responsibilities

You are fully responsible for:

  • The legality of User Content
  • Compliance with this AUP
  • Compliance with local legislation
  • Consequences of publishing Generated Output

GET IT Forward BV is not responsible for use or publication of output by users.

5. Enforcement

GET IT Forward BV may at its own discretion:

  • Issue warnings
  • Restrict features
  • Temporarily suspend accounts
  • Permanently terminate accounts
  • Report abuse to competent authorities
  • Take technical measures to block violations

There is no obligation to notify the user in advance.

2.3 Final Currency

The currency shown during checkout is final.

3. Credit System

3.1 Basis

nanopixo operates entirely on a credit basis. There are no subscriptions.

3.2 Immediate Delivery

Credits are added to the account immediately after successful payment.

3.3 Variable Prices

The price per credit may vary due to:

  • Promotions
  • Bundles
  • Price changes
  • Actions or discounts

4. Dynamic Credit Consumption

Important: GET IT Forward BV reserves the right to adjust at any time the amount of credits required for the use of specific features, AI models, processing levels, or other components of the Service.

These adjustments may be necessary for technical, operational, or economic reasons, including but not limited to:

  • Increase in costs from external providers
  • Changes in AI infrastructure
  • Model upgrades
  • Capacity requirements
  • Optimizations and new features

Previously purchased credits retain their nominal value, but do not guarantee identical processing capacity or equivalent functionality in the future.

This is the legal standard within the AI sector.

5. Credit Validity

5.1 Expiration Date

Credits are valid for 36 months from the purchase date.

5.2 Automatic Expiration

After the expiration date, credits automatically become invalid, without compensation.

5.3 User Responsibility

It is the user's responsibility to use credits in time.

5.4 No Recovery

Expired credits cannot be recovered or refunded.

6. Immediate Delivery & Right of Withdrawal

6.1 Digital Service

Credits are digital services that are delivered immediately. The legal right of withdrawal expires immediately (Directive 2011/83/EU).

6.2 Acknowledgment

By purchasing credits, you acknowledge that:

  • Delivery starts immediately
  • The right of withdrawal expires
  • No refund is possible

7. Refund Policy — No Refunds

7.1 General Principle

GET IT Forward BV does not grant refunds, except where legally required.

7.2 This Includes (Without Limitation):

  • Unused credits
  • Incorrectly purchased bundles
  • Duplicate purchases
  • Dissatisfaction with AI output
  • Quality differences or inconsistency in results
  • Longer processing time than expected
  • Increase in credit consumption per feature
  • Changes to models or functionalities
  • Loss of credits due to incorrect use

7.3 AI Variability

AI output is inherently variable. Unexpected or unwanted output is not grounds for a refund.

8. Transactions & Payment Providers

8.1 External Processing

Payments are processed via external providers. GET IT Forward BV does not store complete payment details.

8.2 User Responsibility

The user is responsible for correct payment settings.

8.3 Final Purchase

A purchase is final once the provider confirms it.

9. Fraud & Abuse

9.1 Blocking

GET IT Forward BV may block or refuse suspicious transactions.

9.2 Measures in Case of Fraud

In case of fraudulent activities (incl. chargebacks), GET IT Forward BV may:

  • Suspend the account
  • Invalidate remaining credits
  • Claim damages where legally permitted
  • Block further access to the Service

10. Price Changes

10.1 Flexibility

GET IT Forward BV may adjust prices at any time.

10.2 Future Purchases

Changed prices only apply to future purchases.

10.3 Existing Credits

Previously purchased credits remain valid according to their nominal value, but not necessarily according to their historical usage capacity (see article 4).

11. Availability of Payment Methods

11.1 Regional Differences

Available payment methods may vary by region.

11.2 Changes

GET IT Forward BV may add, remove, or restrict payment methods at any time.

12. Liability

These Payment Terms follow the limitations from the General Terms and Conditions:

All liability of GET IT Forward BV is excluded to the extent permitted by law.

3. License to the User

The User may:

  • Use the platform for permitted purposes
  • Generate content via available tools
  • Download and use generated output (see article 5)
  • Use templates for own projects

3.3 Prohibited Use

The User may NOT:

4. Ownership of User Content

4.1 Ownership Remains with User

The User retains all intellectual property rights to:

  • Content uploaded by the User
  • Texts, scripts, and concepts entered by the User
  • Own media, images, and videos

4.2 Condition: Lawful Rights

The User warrants that he/she:

  • Owns the uploaded content, or
  • Has permission to upload and process it
  • Does not infringe on third-party rights

4.3 License from User to GET IT Forward BV

By uploading content, the User grants GET IT Forward BV a:

  • Non-exclusive license
  • Worldwide license
  • Royalty-free license (no payment due)
  • Limited license to:
    • Host and store the content
    • Process and transform (AI processing)
    • Display to the User and his/her team members
    • Deliver the Service

4.4 No Claim on User Content

GET IT Forward BV does not claim ownership of User Content and will not use it for:

5. AI-Generated Output

The User retains all rights to content generated via nanopixo, provided that:

Important: AI output may show similarities to:

  • Existing works on which AI models were trained
  • Output from other users
  • Public domain material

GET IT Forward BV does not guarantee that AI output is unique, original, or free from third-party rights.

5.3 User Responsibility

It is the User's responsibility to:

  • Verify that output does not infringe on third-party rights
  • Seek legal advice in case of doubt
  • Handle any third-party claims independently

5.4 Commercial Use

The User may use AI-generated output for:

  • Personal purposes
  • Commercial purposes
  • Publication and distribution
  • Monetization

Provided that the conditions of this statement and the Acceptable Use Policy are met.

6. Templates and Sample Content

Templates offered by GET IT Forward BV may:

  • Be used for own projects

11. Training of AI Models

By default: GET IT Forward BV does NOT use User Content for training its own AI models, unless:

  • The data is fully anonymized
  • Explicit permission has been given
  • It is necessary for quality improvement (anonymized)

11.2 External AI Models

For external AI providers (such as OpenAI, Google), their own terms apply. GET IT Forward BV makes contractual arrangements to prevent unauthorized use.

12. Termination of Rights

12.1 Upon Account Termination

Upon termination of the account:

  • The license to use the platform expires immediately
  • The User retains rights to own content and generated output
  • User Content is deleted according to the retention policy

12.2 Survival of Rights

Intellectual property rights of GET IT Forward BV continue to exist, even after termination.

13. Indemnification

The User indemnifies GET IT Forward BV from all claims, damages, and costs arising from:
